Terms & Conditions
These terms and conditions are applicable to all Web Development projects that are undertaken by Google Web design.
Definitions:-
The Client: The company or individual requesting the services of Web Design MegaStore.
Google Web design: Primary designer/site owner & employees or affiliates.
The contract between Google Web design and the client will be on these conditions to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.
These terms and conditions applied to each user and/or visitor to the Website and/or customers of the Company and governed by English law. Information on this Website is the property of the Company. Copyright law protects the materials enclosed in this site. The contents of the Website are accessible to any user and/or visitor for personal reference only and may not be reproduced in any manner whatsoever either in whole or in part without the prior written permission of the Company or its representatives.
The Company reserves the right in its absolute discretion:
a) To add to or remove any material from the Website or to amend, alter, redesign or change anything contained in or on it at any time; and
b) To monitor, suspend, revoke, or otherwise limit access to the Website at any time.
c) The use of this Website is at the visitor's or users own personal risk. The Company does not warrant the content, precision or authenticity of any material or other information on the Website nor does it warrant that the Website is free from errors, faults, viruses, other computer, or data-corrupting or data-damaging material.
d) The Website contains links to other sites or addresses on the web. External sites are not part of the Website and do not belong to the Company. The Company does not consent or endorse other websites nor is it liable for their content. Descriptions of, or references to products, services or publications within the Website do not constitute or imply their endorsement or recommendation in any way by the Company, its employees or contractors. No reference in the Website to any specific product, process, or service by trade name, trademark, manufacturer, or otherwise, shall be used for promotion or product endorsement purposes…
e) Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, Web Design MegaStore cannot accept liability for any losses incurred due to malfunction, the website or any part of it. The website, graphics and any programming code remain the property of Google Web design until all outstanding accounts paid in full.
f) Any additions to briefs provided will be carried out at the discretion of Google Web design and where no charge is made by Google Web design for such additions, Google Web design acknowledge any liability to guarantee such additions are error free and reserve the right to charge an according amount for any correction to these or further additions. The client agrees to make available, as soon as is reasonably possible to Goole Web Design all materials required completing the site to the agreed standard and within the set deadline.
g) Google Web design will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines. Google Web design will not be accountable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any misconduct on the part of a site owner. E.g., any disputes regarding content/images that had provided to us for inclusion on the site.
h) Google Web design will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.
i) A deposit of 35% is required with any standard project and 50% for database driven projects before any design work will be carried out. This figure may be higher for websites of an adult nature and is non-refundable.
j) Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e. if the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the client’s satisfaction and no refunds can be offered. We do offer free updates for a month after completion to allow for any final amendments that may be required.
k) Google Web design cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
l) The client is expected to test fully any application or programming relating to a site developed by Google Web design before being made generally available for use. Where "bugs", errors or other issues found after the site is live,
m) Google Web design will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.
n) Google Web design will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 6 and to an acceptable level with Mozilla browsers. Google Web design can offer no guarantees of correct function with all browser software.
o) Whilst Google Web design recommends hosting companies to host websites, no guarantees can be made as to the availability or intermission of this service by Google Web design cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.
p) Google Web design reserve the right to refuse to handle in any way, material that may be deemed offensive, illegal or in any way controversial, and also to terminate the free hosting service should the necessity arise.
q) To the maximum extent permitted by law the Company excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred). Damages of any kind arising out of or in connection with any visitor's or user's access to, or use of the Website, or any material thereon, whether based in contract, tort or whether negligent or otherwise, even if the Company has been advised of the possibility of such damage.
